Please read these Terms of Service carefully. By using WidgetInk's website and services, you indicate your acceptance of these terms. If you do not accept these terms, you may not use the Services.
Your use of WidgetInk's services, including the website, widget builder, embeddable widgets, connectors, and any related tools (collectively the "Services") is governed by these terms. If you are using the Services on behalf of an organization, you are agreeing to these terms for that organization and represent that you have the authority to do so.
You must follow the policies made available to you within the Services. Do not misuse our Services - for example, do not interfere with our Services or try to access them using a method other than the interfaces we provide. You may use our Services only as permitted by law.
We may suspend or stop providing our Services to you if you do not comply with our terms or policies, or if we are investigating suspected misconduct. We may also modify, suspend, or discontinue the Services at any time without prior notice.
You may be required to provide personally identifiable information, including contact information and credentials. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You should notify us immediately if you discover unauthorized use of your account.
By making content available through our Services (such as widget configurations, templates, or data), you grant WidgetInk a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display such content solely for the purpose of operating and improving the Services.
Widgets created through WidgetInk are delivered via our CDN and embed script. You are responsible for ensuring that the content displayed in your widgets complies with applicable laws and does not infringe on the rights of third parties. We reserve the right to remove or disable widgets that violate these terms.
When you connect third-party services (such as Shopify, email platforms, or review apps), you authorize WidgetInk to access and use data from those services as necessary to provide our Services. You are responsible for complying with the terms of service of any connected third-party platforms.
Paid subscriptions are billed in advance on a recurring basis. Your payment method will be charged at the beginning of each billing period. We reserve the right to change pricing with reasonable notice. Refunds are evaluated on a case-by-case basis.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use WidgetInk's branding or logos without our written permission. You may not remove, obscure, or alter any legal notices displayed in or along with our Services.
You represent and warrant that:
WidgetInk may at any time, at its sole discretion, suspend or terminate all or part of the Services or your access to them, for any reason or no reason. Upon termination, your right to use the Services will immediately cease.
You agree to indemnify, defend and hold WidgetInk and its officers, directors, employees, and agents harmless from any claims, demands, liabilities, expenses, losses, damages, and legal fees arising from any breach of these Terms or your use of the Services.
In no event shall WidgetInk be liable for any special, indirect, incidental, or consequential damages, including loss of use, lost business, lost data, or lost profits, even if WidgetInk has been advised of the possibility of such damages.
All services are provided on an "as is" basis with no warranty. To the fullest extent permissible by law, WidgetInk disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
Neither party will be liable for any failure or delay resulting from conditions beyond reasonable control, including acts of God, government action, terrorism, labor conditions, or infrastructure failures.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and WidgetInk regarding the Services and supersede any prior agreements or representations.
These Terms shall be governed by and interpreted in accordance with the laws of Singapore. The parties agree to submit to the exclusive jurisdiction of the courts located in Singapore.
